  • Cybercriminals stole $272 million from Ray-Ban accounts

According to the company, the theft occurred due to the negligence of JP Morgan Bank.

A federal judge this week dismissed a lawsuit against JP Morgan Chase Bank alleging cybercriminals stole $272 million from Ray-Ban's account in 2019 due to the bank's negligence.

U.S. District Judge Lewis Lyman dismissed the allegation that JP Morgan was in breach of contract and negligence, but added that EssilorLuxottica (EMTC, Ray-Ban's parent company) could sue the bank for damages.

According to the EssilorLuxottica lawsuit, cybercriminals made 243 fraudulent payments and withdrew a total of $272.1 million from an EMTC account at the New York branch of JP Morgan. The money was deposited into various dummy accounts and nominees around the world. Essilor Luxottica only managed to recover $172 million.

EssilorLuxottica also stated that "From mid-September 2019 to mid-December 2019, EMTC repeatedly exceeded its daily overdraft limit, but JP Morgan did not." Daily transfers from the New York account were to be limited to $10 million, but sometimes exceeded this amount by "more than $20 million."

In addition, JP Morgan Bank said that Essilor could not sue the bank "because EMTC was not the sender of the payment orders and therefore cannot receive a refund."
